Apple, Nike settle Fuelband fitness tracker lawsuit
The refund is a proposed settlement for the class action lawsuit Levin versus Nike Inc. and Apple Inc. in which Levin alleges the companies made false and/or misleading claims for the Fuelband in terms of its ability to count steps, calories and something called NikeFuel which was a point scoring system.
In addition he allegation claims the companies continued to sell the Nike Fuelband even when they knew it could not count steps and calories burned accurately. The Nike Fuelband communicated with the Apple iPhone over Bluetooth as part of its functionality.
The Nike Fuelband was sold for about $150 and the refund is for $15 in cash or $25 as a gift card to be redeemed at Nike stores in the US or online. Apple is included in the lawsuit as it sold the Fuelband in its Apple stores.
Nike and Apple deny the allegations but have agreed to settle "in order to avoid the expense, inconvenience, and distraction of continued litigation," according to the Nike Fuelband Settlement website.
This would also explain why Nike and Apple have only agreed to offer a fraction of the sale price of the Fuelband.
Nike was reported to have laid off most the hardware development team behind the Fuelband in April 2014 and that it would focus on fitness software going forward.
